Vybes Africa merchant terms and conditions
These terms and conditions (Agreement) are entered into between Vybes Africa, a legally registered company in Kenya, and you, the user (or as the legal representative of the business you create on our platform).
This Agreement governs your use of the Vybes Africa platform. By using the platform, you agree to the terms listed below.
1. Access to the Platform
You acknowledge that access to and use of the Platform is subject to your acceptance of and compliance with this Agreement.
2. Data Usage and Privacy
As part of using the Platform and its Services, you agree that we may collect and use certain data, including but not limited to information about your business, inventory, suppliers, and staff (Data).
We use this Data to improve the overall functionality and performance of the platform — including enhancing features, identifying areas for optimization, and refining user experiences.
We assure you that any Data collected will be treated with the utmost confidentiality.
We will not share your Data with any third party unless it has first been anonymized to remove personally identifiable information (PII), or where disclosure is required by law.

3. Merchant Responsibilities
You are responsible for the accuracy and completeness of the data you provide on the Platform.
Any inaccurate or incomplete information may affect the effectiveness of the Services.
You agree not to use the Platform for any unlawful, fraudulent, or unauthorized purposes.
You are solely responsible for maintaining the security of your account credentials and preventing unauthorized access to your account.
4. Intellectual Property
The Platform and all its associated content — including but not limited to software, graphics, text, images, and branding — are the property of Vybes Africa and are protected by intellectual property laws.
You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Platform or its content without our prior written consent.
5. Termination
This Agreement will remain in effect until terminated by either party.
We reserve the right to suspend or terminate your access to the Platform if we believe you have violated any terms of this Agreement.
Upon termination, your access to the Platform and its Services will be revoked, and you must cease all use of the Platform immediately.
6. Amendments
We reserve the right to modify, update, or amend this Agreement at any time.
Any changes will take effect immediately upon posting on the Platform or notifying you through other communication channels.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Kenya.
Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Kenya.
8. General Terms
Our failure to exercise or enforce any right under these Terms and Conditions shall not be deemed a waiver of such right, nor shall it prevent us from exercising or enforcing it later.
You may not transfer any rights or obligations you have under this Agreement without our prior written consent.
These Terms and Conditions constitute the entire agreement between you and Vybes Africa with respect to the subject matter herein and supersede all prior versions.
In the event of inconsistency between these Terms and Conditions and any previous versions, this version will prevail.
